In an open discussion between the attorneys Jeremy Hogan and John E Deaton, the former tweeted the hypothetical possibility of the latter disguising himself as the Ripple lawyer Matthew Solomon and sneaking into the Ripple hearing. Hogan’s comment was in response to Deaton’s revelation that he had been present in the January 30’s hearing of the SEC-LBRY case, representing tech journalist Naomi Brockwell as an amicus curie.
In the early hours of May 27, Hogan shared the blockchain-based network LBRY’s submission of the supplemental brief, seeking clarification for the classification of LBRY tokens as a security. The platform stated that “the clarity is so desperately needed”:
The Commission refuses to provide such clarity and now seeks abroad-based injunction that is neither specific nor clear. Since the Commission has requested injunctive relief specifically against Odysee, the scope of the Commission’s injunctive relief is squarely before the Court. As such, LBRY respectfully requests that the Court provide the clarity that is so desperately needed.
Moved by the similarity of the case with the SEC-Ripple case, Hogan commented that “this is a possible scenario in the Ripple case with the SEC asking for a broad/vague injunction and Ripple seeking clarity from the Judge”.
Responding to Hogan’s tweet, the XRP defendant Deaton posited that the judge would not issue the injunction order, explaining:
The judge promised he would make clear his order did not apply to secondary market sales. I objected to the over-broad injunction language and he said he would not issue an injunction like that.
The revelation was overwhelmingly accepted by Hogan who thanked God for the presence of Deaton in the hearing. He added that he wished for a similar presence of Deaton in the Ripple case hearing too:

The crypto community has been an active recipient of the XRP lawyers’ comments. Some of them acknowledged both Deaton and Hogan as the best lawyers representing the XRP army. There were also many followers who appreciated Hogan’s thoughts.
